SAMHSA is proposing a change that gives law enforcement more access to SUD patient records! This change to Section 2.63 of 42 CFR Part 2 could harm the lives of patients and people in recovery in an extraordinary way…

Comments on the proposed change to Section 2.63 of Part 2 on Law Enforcement are due September 25th by 5:00 p.m. EST!
Comment Now on Proposal 0930-AA30. SAMHSA is proposing a change to Section 2.63 of 42 CFR Part 2 that could harm the lives of patients and people in recovery in an extraordinary way… For forty years, Part 2 has protected people who have sought treatment for alcohol and drug use from having their own records used against them in courts, unless it is a case of serious violence or child abuse. It has never been intended that our SUD treatment records be used in cases of “drug trafficking” against a patient, or another person. People seek treatment to recover from addiction, to change their lives, and believe that the private information they share will be confidential and protected. If you agree that the government should not allow the use of your PRIVATE HEALTH RECORDS in criminal proceedings involving “drug trafficking,” tell them NO CHANGES TO SECTION 2.63 TODAY. You may submit your comments ANONYMOUSLY if you choose, all comments count!
